Three Rivers hears from NJCAA

Three Rivers College has been given a choice by the NJCAA after self-reporting violations by the men's basketball program.
In a letter dated Monday, NJCAA Executive Director Mary Ellen Leicht gave the school two alternatives:
* Place the men's basketball program on probation for the upcoming season, which would ban the Raiders from postseason play, and reduce its scholarships to nine for the next two seasons;
* Or allow a five-member audit team from the NJCAA to investigate the entire athletic program to determine the sanctions.
"Although the ability for a member college to be given alternatives is unusual," Leicht wrote, "I feel the need to offer an in-depth review of the athletic program is warranted."
The college must respond by Tuesday, June 21 or could appeal the decision by Leicht to the NJCAA Executive Committee.
Responding by email, Three Rivers President Dr. Devin Stephenson said, "Three Rivers will appeal the sanctions.
"We have a great tradition of athletic competition at Three Rivers and I will do everything within the scope of my position as president to assure that we continue that success."
Athletic Director Gene Bess declined comment at this time.
"Athletics is an important part of the collegiate experience and provides a means for young men and women to obtain a college degree," Stephenson said. "We will definitely appeal the sanctions and seek relief from the proposed reduction of scholarships."
Three Rivers self-reported three violations after a consultant hired by the college looked into the entire athletic department in April.
In her letter to Stevenson, Leicht writes that the sanctions are based upon the independent audit.
"These violations are similar in nature to those which caused this same program to be sanctioned in 2009," Leicht writes. "As concerning as the continued violations is the fact that the head coach of the men's basketball program has additional responsibilities as the college's athletic director and should be providing leadership for the entire athletic program."
By taking the sanctions, the Raiders could be banned from postseason play for the upcoming season.
"It is my understanding that it is the intention of NJCAA to prohibit Three Rivers from participating in postseason play in 2011-2012 and possibly 2012-2013," Stephenson said. "We plan to appeal that decision as well."
According to Article V Section 17 of the NJCAA bylaws, probation is "the maximum penalty which the (NJCAA) may impose will be forfeiture by the member college of the right to participate in Regional and/or NJCAA sponsored tournaments, meets and games" for one academic year.
At the end of the probationary period, the college must request reinstatement and the Executive Committee of the NJCAA must vote to either grant it or extend the penalty an additional year.
Should the college choose the audit, Three Rivers would fully fund a five-member audit team by the NJCAA.
The audit team would be "given full and complete access to all records including but not limited to college, sport camp, and booster club documents (financial and otherwise) as well as the ability to interview all key individuals having dealings with the athletic program and college," Leicht says in her letter.
"The NJCAA would reserve all sanctions pending the outcome of that audit" and "sanctions more extensive than those listed ... may be imposed."
In 2009, the NJCAA limited the men's basketball program to 11 scholarships during the 2010-11 and 2011-12 seasons for rule violations that occurred between 2005-08. Three Rivers was found to have violated of rules concerning payments for healthcare and tuition costs. The sanctions came following a 10-month inquiry by the NJCAA, which did not put Three Rivers on probation at the time.
The violations reported to the NJCAA in May were:
* The school providing game-day meals at home events to men's basketball players that exceed the limit set by the NJCAA;
* A member of the Booster Club providing groceries on a monthly basis to players on the men's basketball team;
* Two payments concerning medical coverage that exceeded the limit set by the NJCAA.
The compliance review report was done by TIG Consulting at the request of the college. Interviews were conducted April 5-7, the report says, and the findings were sent to Board chairman Wilbur Thornton on April 15.
The two payments of improper medical coverage came in 2009 and were not associated with an athletic injury, the report says. One totaled $203 while another was $78.
The game-day meals provided to players exceeded NJCAA limits and the groceries provided by a member of the booster club violates Article VIII Section 1 A of the NJCAA Eligibility Rules.
Both infractions occurred between August 2009 and March 2011, the report states.
An athlete may only receive grant-in-aid from the school and can only include tuition and fees, room and board, required course-related books and transportation costs one time per academic year.
The school is responsible for "acts of outside individuals or organizations when performed with the knowledge of any member of the administrative or athletic staff."

The college can ask for a written appeal or a hearing at the next board meeting. If there's a written appeal the NJCAA will respond within 21 days.
